Important Notice
1. Indonesia
In accordance with Indonesian Law and the Articles of Association of PT Sea Horse and its subsidiaries (“PTSH”), any Contract is required to be signed by the Board of Directors (“BOD”) of PTSH, or any other person who is duly authorised by the BOD through the issuance of a Power of Attorney (“POA”) to effectively represent the BOD and PTSH in any such matter. The POA must be presented To Whom It May Concern prior signature of any contract; failure to do so renders the contract voidable under Indonesian Law. The BOD and PTSH, however, reserve the right to ratify such invalid contract at its sole discretion.
2. Singapore, Malaysia, PNG
Any and all contracts entered into with any other entity within the Amsbach Group of Companies are required to be signed by the Director of the contracting entity or any other person, e.g. General Manager, who is duly authorised by the Director of that entity to represent the entity through the issuance of a power of attorney (“POA”). The POA must be presented To Whom It May Concern prior signature of any contract; failure to do so will result in the entity NOT being legally bound under such contract. The entity and its Director, however, reserve the right to ratify the contract at their sole discretion.
